1. Introduction

These Terms and Conditions apply to all sales and services provided by Ape Suspension and govern your use of our website, products, and services. By purchasing products or services from Ape Suspension, you agree to these Terms and Conditions.

2. Consumer Guarantees

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (ACL).
If goods are defective or fail to meet a consumer guarantee, you may be entitled to a remedy, including repair, replacement, or refund.

3. Products and Fitment Responsibility

3.1 Product Sales

  • Products sold by Ape Suspension are supplied in good faith and are suitable for their intended purpose when correctly installed and used in accordance with the manufacturer’s specifications.

3.2 DIY (Self) Installation

  • If you choose to install suspension components yourself (DIY install) or engage a third party to do so, you do so at your own risk.
  • Ape Suspension accepts no responsibility or liability for issues arising from incorrect installation, misuse, or modifications made to the vehicle that affect the product’s performance.
  • It is the customer’s responsibility to ensure components are installed by a qualified and experienced professional, particularly in relation to safety-critical suspension components.

3.3 Product Compatibility

  • Customers must ensure the compatibility of all third-party components (e.g., upper control arms, tyres, or other aftermarket modifications).
  • Ape Suspension cannot be held liable for issues arising from interactions between products not supplied or installed by us.

4. Warranties

4.1 Manufacturer Warranties

  • Products are covered by manufacturer warranties. Ape Suspension assists customers in processing warranty claims but is not responsible for the approval or outcome of such claims.
  • Manufacturer warranty claims are subject to their terms, including correct installation and use.

4.2 Warranty Exclusions

The following situations may void your warranty:

  • Incorrect installation by a non-qualified party.
  • Failure to follow installation instructions or specifications.
  • Modifications to the vehicle outside of approved applications.
  • Use of the vehicle in a manner not intended by the product’s design (e.g., extreme off-roading beyond product capacity).

5. Returns and Refunds Policy

5.1 Change of Mind

  • We do not provide refunds or exchanges for change of mind purchases.

5.2 Faulty Products

  • If a product is deemed faulty due to a manufacturing defect, Ape Suspension will provide a repair, replacement, or refund in accordance with the ACL.
  • Ape Suspension reserves the right to inspect and test the product or request an independent assessment before determining the appropriate remedy.
  • Products returned for inspection must be complete, unmodified, and in the condition they were supplied.

6. Installation Services

6.1 Scope of Service

  • Installation services are performed by qualified technicians according to manufacturer guidelines.
  • Once a job is completed, customers are responsible for post-installation maintenance, including alignment, torque checks, and inspection as recommended.

6.2 Post-Installation Responsibilities

  • We recommend a wheel alignment after suspension installation.
  • Regular maintenance and safety checks are the customer’s responsibility. Failure to do so may impact product performance and warranty.

7. Limitation of Liability

  • Ape Suspension is not liable for any loss or damage, whether direct, indirect, incidental, or consequential, arising from:
    • Incorrect installation by the customer or third party.
    • Use of products beyond their intended scope.
    • Incompatibility with non-standard vehicle modifications.
    • Failure to comply with post-installation recommendations.
  • Our maximum liability in connection with any product supplied shall not exceed the purchase price of the product.

8. Independent Inspection

  • In the event of a dispute regarding product defect or failure, Ape Suspension reserves the right to request or arrange for an independent third-party inspection by a licensed vehicle examiner or engineer.
  • Costs associated with independent assessments may be borne by the customer if no defect is found.

9. Dispute Resolution

  • We encourage customers to contact us directly to resolve concerns.
  • If a dispute cannot be resolved, both parties may refer the matter to Consumer Protection WA or the Magistrates Court of Western Australia, if applicable.

10. Privacy

We collect and handle your personal information in accordance with our Privacy Policy, which is available on our website.

11. Amendments

Ape Suspension reserves the right to amend these Terms and Conditions at any time. Updated versions will be posted on our website.
